Terms & Conditions – Viralspace

Welcome to Viralspace! These Terms & Conditions ("Terms") form a legally binding agreement between you ("User", "you") and Viralspace (the "Platform", "we", "us", or "our") regarding your access to and use of our website, services, Certified Affiliate Training Program, Creator Pages, CPS (Cost Per Sale) affiliate marketplace, escrow-protected checkout, and related features. By registering, enrolling in training, claiming offers, creating/promoting Creator Pages, listing products, making purchases, or otherwise using Viralspace, you agree to these Terms.

If you do not agree, do not use the Platform.

1. Eligibility & Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use Viralspace. You agree to provide accurate, current information during registration and to keep it updated. We reserve the right to suspend or terminate accounts for inaccurate information, fraud, or violation of these Terms.

2. User Roles & Responsibilities

• Affiliates/Creators: Claim CPS offers, generate/use Creator Pages, promote products ethically and in compliance with laws (including FTC disclosure rules: clearly mark promotions as #ad or similar). You are responsible for all content on your Creator Page and promotions.
• Sellers/Brands: List accurate product details, fulfill orders promptly, handle returns/refunds per your policy, and confirm deliveries to release escrow funds and commissions.
• Buyers: Provide accurate payment/shipping info; payments held in escrow until delivery confirmation.

3. Certified Affiliate Training Program

Enrollment is open to registered users. Training materials are for personal, non-commercial use. Certification grants access to premium offers/creator features but does not guarantee earnings. We may update or discontinue training content without notice.

4. CPS Offers, Commissions & Payments

Commissions are performance-based (CPS) and paid only on confirmed sales (post-escrow release and delivery verification). Rates are set per offer; we deduct platform fees. Payouts occur via approved methods (e.g., PayPal, bank transfer) after minimum threshold and on schedule. Disputes must be raised within 30 days.

5. Escrow & Transactions

Buyer payments are held in escrow until seller confirms delivery (or auto-release per policy). We use third-party processors (PCI-DSS compliant); we do not store full payment details. Disputes handled via our resolution process; we may freeze funds during investigation.

6. Prohibited Conduct

• Spamming, fake traffic, incentivized clicks, or fraudulent promotions.
• Promoting via misleading claims, malware, or illegal content.
• Manipulating tracking, self-referrals, or cookie stuffing.
• Violating intellectual property, privacy laws, or FTC/ASA disclosure rules.
• Any activity harming the Platform, users, or reputation.

7. Intellectual Property

We own the Platform, training materials, and trademarks. You grant us a license to use your profile/content for promotion. Affiliates/sellers retain rights to their own content but grant us usage rights for marketplace display.

8. Termination & Suspension

We may suspend/terminate accounts immediately for violations, fraud, or at our discretion. Upon termination, unpaid commissions may be forfeited if due to breach. You may close your account; pending commissions paid per policy.

9. Disclaimers & Limitation of Liability

Services provided "as is" without warranties. We are not liable for indirect damages, lost profits, or third-party actions. Maximum liability limited to fees paid in prior 12 months (where applicable). Escrow disputes resolved per our process; we act as facilitator, not party to sales contracts.

10. Dispute Resolution & Governing Law

Disputes resolved via binding arbitration (or small claims court for qualifying amounts) in [Your Jurisdiction, e.g., Delaware, USA]. These Terms governed by laws of [Your Jurisdiction], without regard to conflict rules.

11. Changes to Terms
